Welcome to Slay by Candie. These Terms & Conditions govern your use of the Slay by Candie website and your purchase of our products. By using the website, creating an account, or placing an order, you agree to these Terms & Conditions.

Please read them carefully before placing an order. If you do not agree with these terms, please do not use the website or purchase our products.

1. About Slay by Candie

Slay by Candie is a Nigerian fashion retailer offering dresses, co-ord sets, loungewear, bags, and other fashion products in limited runs.

In these Terms & Conditions, “Slay by Candie”, “we”, “us”, and “our” refer to Slay by Candie. “You” and “your” refer to any person who accesses our website or purchases our products.

2. Eligibility

You must be at least 18 years old to create an account or place an order through our website.

By using the website or placing an order, you confirm that:

• You are at least 18 years old;
• You have the legal capacity to enter into a binding contract; and
• The information you provide to us is accurate, complete, and current.

If you are under 18, you may use the website only with the involvement and supervision of a parent or legal guardian who agrees to these Terms & Conditions.

3. Website use

You may use our website only for lawful purposes and in accordance with these Terms & Conditions.

You must not:

• Use the website for any unlawful, fraudulent, abusive, or misleading purpose;
• Attempt to gain unauthorised access to the website, our systems, or another customer's account;
• Introduce viruses, malware, or other harmful material;
• Interfere with the security, operation, or availability of the website;
• Scrape, copy, reproduce, or commercially exploit website content without our written permission;
• Misrepresent your identity or your relationship with Slay by Candie; or

We may suspend or terminate access to the website where we reasonably believe that these Terms & Conditions have been breached.

You are responsible for:

• Keeping your login details confidential;
• Ensuring that information in your account remains accurate and up to date; and
• All activity carried out through your account.

Please notify us promptly if you believe that your account has been accessed without your permission. We are not responsible for losses resulting from your failure to keep your account credentials secure, except where such loss results from our breach of applicable law or our negligence.

5. Products and product information

We make reasonable efforts to ensure that product descriptions, photographs, measurements, colours, and other information on the website are accurate and current.

However:

• Colours may appear slightly different depending on your device or screen settings;
• Measurements may vary slightly between products and sizes;
• Product availability may change without notice; and
• Products may have minor variations consistent with small-batch sourcing.

Our products are generally sold as new goods unless we clearly state otherwise.

We reserve the right to correct errors, update product information, and withdraw products from sale at any time before an order is accepted.

6. Prices and payment

All prices on the website are displayed in Nigerian Naira (₦), unless expressly stated otherwise.

Prices may change from time to time. A price change will not affect an order that we have already accepted, except where the order involves an obvious pricing or listing error.

The total amount payable, including any applicable delivery charges, will be shown before you complete payment.

You are responsible for providing accurate payment and billing information. Payment must be successfully authorised before an order can be processed.

We use third-party payment providers to process payments. Payment details are handled in accordance with the relevant payment provider's terms and applicable data protection requirements. We do not store complete payment card details on our own servers.

7. Orders and acceptance

When you place an order, you are making an offer to purchase the selected products at the displayed price and on these Terms & Conditions.

After you place an order, we may send an order acknowledgement. This acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it.

An order is accepted only when we send confirmation that the order has been accepted or dispatched, or when we otherwise expressly confirm acceptance.

We may decline, cancel, or limit an order before acceptance in appropriate circumstances, including where:

• A product is unavailable;
• There is an obvious pricing, product description, or technical error;
• We suspect fraud, unauthorised activity, or other unlawful conduct;
• We are unable to verify the information provided;
• A product has been ordered in unusually large quantities; or
• The order cannot reasonably be fulfilled.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order using the original payment method where reasonably possible.

8. Limited-run products and stock availability

Many Slay by Candie products are produced in limited runs. Adding an item to your shopping bag does not reserve or guarantee that item.

Products are reserved only after checkout has been successfully completed and payment has been confirmed.

If an item becomes unavailable before your order is accepted, we will notify you and refund any amount paid for that item.

9. Delivery and shipping

We deliver to addresses within Nigeria.

Delivery options, estimated delivery periods, and applicable delivery charges will be displayed at checkout or communicated to you before payment.

We offer free shipping across Nigeria on orders over ₦100,000, subject to any exclusions or conditions displayed at checkout.

Delivery estimates are provided in good faith but may be affected by circumstances outside our reasonable control, including courier delays, traffic, weather, public holidays, industrial action, security concerns, or incorrect delivery information.

You are responsible for providing a complete and accurate delivery address and contact details. If delivery is unsuccessful because the information provided is incorrect or because no one is available to receive the order, additional delivery charges or arrangements may apply.

If we become aware of a significant delivery delay, we will take reasonable steps to notify you and provide an updated estimate.

Risk in the products passes to you when the products are delivered to you or to a person you have authorised to receive them. Nothing in this section limits any rights you may have under applicable Nigerian law.

10. Returns and refunds

Because our pieces are bought and sold in small, limited runs, all sales are final. We do not offer refunds or exchanges for change of mind, incorrect size selection, or similar reasons.

Our position on damaged, defective, or incorrectly supplied products is set out in our separate Shipping & Returns page, which forms part of these Terms & Conditions.

We will not exclude or restrict any statutory right or remedy relating to defective, unsafe, or materially non-conforming goods that cannot lawfully be excluded under applicable Nigerian consumer protection law.

11. Faulty, damaged, or incorrect products

If your order arrives faulty, damaged, incomplete, or different from what you ordered, please contact us promptly at legal@slaybycandie.com with your order details and, where possible, photographs of the issue.

We may request reasonable information to assess the problem. Where a product does not conform to the order or is defective, we will take appropriate action in accordance with applicable law, which may include repair or replacement. Nothing in this section limits any non-excludable statutory right you may have.

You will not be required to bear reasonable return costs for products that are faulty, damaged before delivery, incorrectly supplied, or otherwise do not conform to the contract, subject to reasonable verification.

12. Promotions and discount codes

Promotional offers and discount codes are subject to any specific terms communicated with the relevant promotion.

Unless otherwise stated:

• Discount codes must be applied at checkout;
• Discount codes cannot be exchanged for cash;
• Discount codes cannot be combined with other offers;
• Discount codes may apply only to eligible products;
• A discount code cannot be applied retrospectively to an order already placed; and
• We may withdraw or amend a promotion where permitted by law.

The terms of a particular promotion will prevail over these general terms to the extent of any inconsistency.

13. Intellectual property

All content on the website, including product images, photographs, graphics, logos, text, layouts, videos, trade marks, the Slay by Candie name, and other materials, is owned by or licensed to Slay by Candie and is protected by applicable intellectual property laws.

• The content does not infringe another person's rights;
• The content is not unlawful, abusive, defamatory, obscene, or harmful; and
• You have obtained any necessary consent from people appearing in the content.

You grant Slay by Candie a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, display, and distribute the content for legitimate business, marketing, and promotional purposes.

We may remove or decline to publish content that we reasonably consider inappropriate or inconsistent with these Terms & Conditions.

15. Privacy and data protection

We collect and process personal information in connection with website use, account administration, order processing, delivery, customer support, payments, marketing, and related business activities.

• The website will be free from viruses or other harmful components; or
• Every product shown on the website will remain available.

18. Liability

Nothing in these Terms & Conditions excludes or limits liability that cannot lawfully be excluded or limited under Nigerian law, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or a consumer's non-excludable statutory rights.

Subject to the preceding paragraph and to the maximum extent permitted by law, Slay by Candie will not be liable for indirect, incidental, special, punitive, or consequential loss or damage arising from or relating to:

• Your use of, or inability to use, the website;
• A delay or interruption in website availability;
• Loss of data, profits, revenue, business, goodwill, or anticipated savings; or
• Any matter otherwise arising from these Terms & Conditions or an order.

Subject to applicable law, our total liability for any claim relating to a particular purchase will not exceed the amount you paid for the relevant order.

This limitation does not affect any remedy or liability that cannot lawfully be limited or excluded.

19. Events outside our reasonable control

We will not be responsible for a failure or delay in performing our obligations where the failure or delay results from an event outside our reasonable control.

Such events may include natural disasters, epidemics, pandemics, war, terrorism, civil unrest, government action, power or telecommunications failures, transport disruption, labour disputes, security concerns, or failures of third-party service providers.

We will take reasonable steps to minimise the effect of such events and will resume performance as soon as reasonably possible.

21. Governing law

These Terms & Conditions and any contract between you and Slay by Candie are governed by the laws of the Federal Republic of Nigeria, as applicable in Lagos State.

Any provision of Nigerian law that gives consumers rights or protections that cannot lawfully be excluded will continue to apply.

22. Dispute resolution and jurisdiction

We encourage you to contact us first so that we can try to resolve any complaint or dispute informally.

If a dispute cannot be resolved informally, it will be subject to the jurisdiction of the competent courts in Lagos State, Nigeria, unless applicable law provides otherwise.

Nothing in this section prevents a consumer from exercising any mandatory statutory right or pursuing a remedy before a legally competent regulatory body or court.

23. Entire agreement

These Terms & Conditions, together with the Privacy Policy, Shipping & Returns page, applicable delivery information, and any specific terms displayed at checkout or provided for a promotion, constitute the entire agreement between you and Slay by Candie concerning your use of the website and purchase of products.

They replace any previous discussions, representations, understandings, or agreements relating to the same subject matter, except where a separate written agreement expressly applies.

24. Severability

If any provision of these Terms & Conditions is found to be unlawful, invalid, or unenforceable, that provision will be modified or removed only to the extent necessary.

The remaining provisions will continue in full force and effect.

25. Waiver

If we do not immediately enforce a right or provision under these Terms & Conditions, this does not mean that we have waived that right or provision.

A waiver will be effective only if made expressly and in writing. A waiver of one breach will not constitute a waiver of any later breach.

26. Amendments

We may update these Terms & Conditions from time to time to reflect changes to our business, website, products, services, legal requirements, or operational practices.

The version in effect when you place an order will generally apply to that order, unless a change is required by law or expressly agreed otherwise.

Nothing in these Terms & Conditions creates a partnership, joint venture, employment relationship, or agency relationship between you and Slay by Candie.

You may not represent that you have authority to bind Slay by Candie.
